These Terms of Service (“Terms”) govern your use of the Darwich Law Firm website located at www.darwichlegal.com (the “Site”), our contact form, and any SMS communication you opt in to receive from us. By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Site.
1. No Legal Advice
The information on this Site is provided for general informational purposes only and is not legal advice. 2. No Attorney-Client Relationship
Your use of the Site, submission of the contact form, exchange of email, or receipt of SMS messages does not by itself create an attorney-client relationship between you and Darwich Law Firm or any of its attorneys. An attorney-client relationship is formed only after we have (a) completed a conflicts check, (b) discussed your matter with you, and (c) executed a written engagement agreement signed by both you and the firm.
Do not send confidential or time-sensitive information through the contact form, by email, or by SMS before an engagement agreement is in place. Information you submit before we have agreed to represent you is not protected by the attorney-client privilege.
3. Prior Results Disclaimer
Any references on this Site to case results, settlements, verdicts, testimonials, or other outcomes are examples of past matters and do not guarantee or predict a similar outcome in your case. Every case is different and must be judged on its own facts, circumstances, and applicable law.
4. Jurisdictional Scope
Darwich Law Firm attorneys are licensed to practice in Texas, New Mexico, Arizona, and Ohio. We do not seek to represent anyone in any jurisdiction where this Site does not comply with local rules governing attorney advertising or solicitation. If you contact us from a jurisdiction in which our attorneys are not licensed, we may decline to represent you or refer you to appropriate counsel.
5. The Darwich Law Firm, Co., LPA Messaging Terms of Service
Client Intake & Appointments. Text messages include scheduling an initial call, appointment reminders, intake follow-ups, and secure links for e-signing documents.
You can cancel the SMS service at any time. Just text “STOP” to the short code. After you send the SMS message “STOP” to us, we will send you an SMS message to confirm that you have been unsubscribed.

10. Copyright Complaints (DMCA)
If you believe that content on the Site infringes your copyright, please send a written notice that complies with the Digital Millennium Copyright Act (17 U.S.C. § 512) to our designated agent at omar@darwichlegal.com. Your notice must identify the copyrighted work, the allegedly infringing material and its location on the Site, your contact information, a statement of good-faith belief that the use is not authorized, and a statement (under penalty of perjury) that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

12. Disclaimer of Warranties
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, DARWICH LAW FIRM DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DARWICH LAW FIRM AND ITS ATTORNEYS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SITE, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).
Nothing in this section limits liability for professional malpractice, gross negligence, intentional misconduct, fraud, or any liability that cannot be limited or excluded under Texas law or the Texas Disciplinary Rules of Professional Conduct. This section does not modify or waive any rights or obligations arising under a signed engagement agreement between you and the firm, which is governed by that agreement and applicable rules of professional conduct.
14. Indemnification
You agree to indemnify and hold harmless Darwich Law Firm and its attorneys, employees, and agents from any claim, demand, loss, or expense (including reasonable attorney's fees) arising from (a) your breach of these Terms, (b) your misuse of the Site, or (c) your violation of any law or the rights of a third party. This indemnity does not apply to claims arising from the firm's own conduct.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to the personal jurisdiction of those courts. Any dispute concerning legal representation is separately governed by the terms of your engagement agreement with the firm and by the Texas Disciplinary Rules of Professional Conduct.
16. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Material changes will be posted here. Your continued use of the Site after a change becomes effective constitutes acceptance of the revised Terms.
17. Miscellaneous
Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms is not a waiver of that provision or of any other right.
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Darwich Law Firm concerning your use of the Site and supersede any prior agreements on that subject.
Force Majeure. We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control.
